Terms of Service

These Terms of Service ("Terms") govern your use of the websites, products, and services provided by 5280 Parking, a brand of VIP Parking Solutions ("5280 Parking," "we," "us," or "our"). By accessing our websites, purchasing a parking permit, using our full-service parking management, or subscribing to our OpenParking software, you agree to these Terms. If you do not agree, please do not use our services.
Who we are
5280 Parking provides parking management for multifamily apartment communities, HOAs, and similar properties. We offer two services:
- Full-service parking management — our team manages permits, billing, signage, enforcement, and resident support for a property under an agreement with the property owner or manager.
- OpenParking software — a self-serve subscription platform that lets operators run their own parking program, including permit sales, guest checkout, and enforcement tools.
Accounts and eligibility
You must be at least 18 years old and able to form a binding contract to use our paid services. You are responsible for keeping your account credentials secure and for all activity under your account. You agree to provide accurate, current, and complete information when registering a vehicle, purchasing a permit, or creating an account.
Permits and parking
A parking permit grants a limited, revocable license to park a registered vehicle in a designated area, subject to the rules of the property and the permit type you purchase. Permits are non-transferable unless stated otherwise. Purchasing a permit does not guarantee the availability of a specific space unless the permit is expressly for a reserved space. Vehicles parked in violation of posted rules may be subject to notices, citations, immobilization, or towing at the vehicle owner's expense, in accordance with property rules and applicable law.
Payments
Prices are shown at the time of purchase. By providing a payment method, you authorize us and our payment processor to charge the applicable fees, including recurring subscription fees and any applicable taxes. Card payments are processed by third-party providers (such as Stripe); we do not store full card numbers. If a payment fails, we may suspend or cancel the associated permit or subscription.
OpenParking subscriptions
OpenParking is offered on a subscription basis starting at $50 per month plus per-permit fees, with a 14-day free trial. Unless you cancel before the trial ends, your payment method will be charged when the trial concludes, and then on each recurring billing date. Subscriptions renew automatically until cancelled. You may cancel at any time; see our Refund & Cancellation Policy for details on how cancellations and refunds are handled. Current plans and fees are shown at openparking.app.
Acceptable use
You agree not to misuse our services, including by attempting to gain unauthorized access, interfering with the platform, submitting false vehicle or payment information, or using the services to violate any law. We may suspend or terminate access for conduct that violates these Terms or that we reasonably believe is harmful to us, our customers, or others.
Third-party services
Our services rely on third parties, including payment processors, mapping, license-plate recognition, and communications providers. Their services are governed by their own terms, and we are not responsible for their acts or omissions.
Disclaimers
Our services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. We do not warrant that the services will be uninterrupted or error-free.
Limitation of liability
To the fullest extent permitted by law, 5280 Parking and VIP Parking Solutions will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, arising out of or related to your use of the services. Our total liability for any claim relating to the services will not exceed the amount you paid to us for the service giving rise to the claim in the twelve months before the claim.
Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the services after changes take effect constitutes acceptance of the updated Terms.
Governing law
These Terms are governed by the laws of the State of Colorado, without regard to its conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Colorado.
